Modifications to the Cookies Policy
This Cookies Policy could be modified depending on the legislative and regulatory requirements, or in order to adapt said policy to the instructions issued by the Spanish Agency for Data Protection. Therefore, users are advised to visit it periodically. When significant changes occur in this Cookies Policy, they will be communicated to users via email.
IMPLEMENTATION OF THE COOKIES POLICY
A banner containing the Cookie Notice and also the option to configure them must be implemented on the Website, that is, allowing their acceptance or rejection separately. This banner must appear visible on the user’s screen, even if the user scrolls, or navigates in different sections of the website itself.
It is advisable that the information be provided in layers, including information summarized in a first layer and more detailed information in a second layer, all in accordance with the recommendations of the Spanish Data Protection Agency (“AEPD”) established both in its new Guide on the use of Cookies, published on July 28, 2020, as in its Guide for the fulfillment of the duty to inform.
Taking into account the above, in the first layer (the banner about cookies), the following should be detailed:
-
First layer (Cookie Notice) The identity of the person responsible for the treatment;
-
A reference to the use of third-party cookies, if any;
-
The purpose of the cookies (specifically indicating whether profiles are made based on user navigation and the purpose of these profiles, for example, in the cases of offering personalized advertising);
-
A link to access the second layer of information, (“COOKIES POLICY”), where the rest of the information can be consulted;
-
An express acceptance mechanism that allows closing the cookie notice, by implementing an “ACCEPT” button;
-
A mechanism in which the User can configure cookies, choosing in a granular way which ones they want to authorize. (A link to a configuration panel should be included, with a text similar to the following: “Configure or reject the use of Cookies HERE”). Here’s what the banner text should look like:
“We use our own and third-party cookies for analytical purposes and to show you advertising related to your preferences, based on a profile made from your browsing habits. Click HERE for more information. You can accept all cookies by pressing the “Accept” button or configure or reject their use by clicking HERE
TO ACCEPT.
Regarding this first layer example, it is important, therefore, to take into consideration that (i) it must be added as a fixed banner on the website and that (ii) cookies cannot be loaded until the user expressly accepts (by clicking of the “OK” button). In addition, (iii) the user must be able to withdraw their consent at any time, being able to access the Configuration panel enabled in “You can accept all cookies by pressing the” Accept “button or configure or reject their use by clicking HERE”.
In addition, in this configuration board the user must be able to accept separately the enabling of cookies by categories / purposes (for example, the user must have the possibility to choose to accept analytical cookies and not behavioral advertising cookies), implementing by example YES / NO boxes.
Notwithstanding the foregoing, the maximum degree of granularity (cookie-by-cookie selection) should be avoided, since excess information makes decision-making difficult.
Finally, and in relation to third-party cookies, it is sufficient to identify them by name or by the brand with which they are identified to the public, without including the full company name.
Configuration Panel
The configuration panel must be offered through a link inserted in the Cookie Notice or first layer of information, so that a pop-up window appears through a table (so that it is more visual) so that the user can proceed to accept / reject the enabling of groups of cookies in a granular way depending on the different categories that you use on the Website (except for session / technical cookies (in this case they are called “necessary”), which are exempt from this duty to consent, but it is advisable to report its existence, as indicated in the Cookies Policy).
It must include information on the expiration of the cookie, the developer, etc, and a button must be included in said panel that allows the user to reject all cookies, to respect the requirement that it is as easy to withdraw consent as it is to give it.
For these purposes, for example, this requirement will be considered satisfied if the configuration panel includes a button to save the choice of cookies made by the user, expressly specifying in the new guide on the use of cookies from the AEPD that, if the user saves his choice without having selected any cookie, it will be equivalent to the rejection of all cookies.
Taking into account the above, we indicate below how the text should be to include in the Configuration Panel, in the event of the save button of the user’s choice of cookies:
“When you press” Save settings”, the selection of cookies you have made will be saved. If you have not selected any option, pressing this button will be equivalent to rejecting all cookies.
SAVE SETTINGS
The second layer, that is, the text of the Cookies Policy, must be detailed as follows:
Second Layer (Cookies Policy) In the banner of the Cookie Notice, in addition to the configuration panel that we specified in previous lines, a link must also be included in “Click HERE for more information” that redirects the User to the full text of the Cookies Policy that we have included in this Dossier.
